1. Introduction

Welcome to ReferMich ("ReferMich", "we", "us", "our"). ReferMich is a Germany-based employee referral platform that connects job seekers ("Candidates") with verified employees ("Referrers") who may voluntarily refer candidates for job opportunities within their companies.

By accessing or using ReferMich (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform.

2. Definitions

For the purpose of these Terms:

• "Candidate" means a job seeker using the Platform to request referrals.
• "Referrer" means a verified employee who posts job opportunities or reviews referral requests.
• "Referral Request" means a request sent by a Candidate asking a Referrer to consider making a referral.
• "Referral" means a voluntary internal recommendation made by a Referrer to their employer.
• "Job Listing" means a role shared on the Platform by a Referrer.
• "Hire" means a confirmed employment relationship between a Candidate and an employer, independent of ReferMich.

3. Eligibility

You must:

• Be at least 18 years old
• Provide accurate and truthful information
• Have legal capacity to enter into these Terms

ReferMich may suspend or terminate accounts that provide false or misleading information.

4. Description of Services

ReferMich provides a platform where:

• Referrers may share job opportunities from their employers
• Candidates may request referrals by submitting their profile, LinkedIn, and CV
• Referrers decide entirely at their own discretion whether to approve or decline a referral request

ReferMich does not:

• Act as an employer, recruiter, or staffing agency
• Guarantee interviews, job offers, or employment outcomes
• Participate in hiring decisions

5. Referral Process & Responsibilities

5.1 Candidate Responsibilities

Candidates agree that:

• Their LinkedIn profile and CV will be reviewed by Referrers
• They will request referrals only for companies that are not their current employer
• All information submitted is accurate and lawful

5.2 Referrer Responsibilities

Referrers:

• Are under no obligation to approve any referral request
• Act independently and voluntarily
• Are solely responsible for deciding whether to proceed with a referral

5.3 No Obligation Clause

Approval of a referral request does not obligate the Referrer to complete a referral or communicate further.

6. Profile Visibility & Data Sharing

• User profiles are private by default
• Profiles are shared only when a Candidate initiates a referral request
• Referrer identity is revealed only after referral approval
• Chat between users is enabled only after approval

ReferMich does not make profiles publicly searchable.

7. Payments & Referral Bonuses

• Referral bonuses, if any, are paid by employers, not by ReferMich
• ReferMich does not guarantee bonus eligibility or payment
• ReferMich is not a party to any compensation agreement between Referrers and employers
• Any platform fees will be disclosed separately, where applicable

Users are responsible for any applicable tax obligations.

8. User Conduct

Users must not:

• Provide false or misleading information
• Impersonate others
• Abuse, harass, or pressure other users
• Use the Platform for spam or solicitation
• Upload unlawful or infringing content

Violations may result in account suspension or termination.

9. User Content & License

By uploading content (including CVs, messages, and profile data), users grant ReferMich a non-exclusive, limited license to store, display, and process such content solely for operating the Platform.

Users retain ownership of their content.

10. Data Protection & GDPR

ReferMich processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and German data protection laws.

Users have the right to:

• Access their data
• Correct inaccurate data
• Request deletion
• Restrict processing
• Data portability

11. Disclaimer of Guarantees

ReferMich provides the Platform "as is" and "as available".

We do not guarantee:

• Job offers or interviews
• Referral success
• Platform availability without interruption
• Accuracy of job listings or user content

12. Limitation of Liability

To the maximum extent permitted by law, ReferMich shall not be liable for:

• Employment decisions
• Loss of opportunity or income
• Actions or omissions of users or employers
• Indirect or consequential damages
• Data loss or service interruptions

13. Indemnification

Users agree to indemnify and hold harmless ReferMich from any claims arising from:

• Misuse of the Platform
• Breach of these Terms
• Violation of law or third-party rights

14. Termination

ReferMich may suspend or terminate accounts:

• For violations of these Terms
• To comply with legal obligations
• To protect other users or the Platform

Users may delete their account at any time via Settings.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

Exclusive place of jurisdiction for all disputes shall be Erding, Germany, to the extent legally permissible.
